Request Your Inmate File

The January 16, 2024 deadline for requesting inmate records has passed and The Claims Administrator is no longer accepting or processing requests for inmate records.

 

Submit a Claim

The deadline to submit a Claim Form and all required supporting documentation was October 16, 2024. Late Claims will not be accepted.

 

Payments to Successful Claimants

Under the terms of the Settlement Agreement, the Claims Administrator has until mid-September 2026 to issue payments to successful Claimants.

 

Payments will be sent by cheque to the last mailing address on file with the Claims Administrator unless the Claimant provides direct deposit information to the Claims Administrator. You may call the Administrator   to update your payment information. Please note that all changes to payment information will result in a delay in delivery of your payment.

Sabourin v His Majesty the King in right of Ontario, Court File No 1406/19 CP

 

A Settlement has been approved in two certified class action lawsuits against Ontario (the “Defendant”): Johnson v Ontario (the “Johnson/Hayne Action”) and Sabourin v Ontario (the “Sabourin Action”). The lawsuits alleged that the Defendant negligently operated the EMDC, causing Class Members harm and violating their rights. The Defendant denies those allegations, and the Court did not decide who was right. The Parties instead decided to settle the lawsuits.

 

The Ontario Superior Court of Justice approved the Settlement on September 14, 2023.

Important Deadlines:

 

• The Claims Administrator and Referee have now completed their review of all Claims received on or before October 16, 2024. Late Claims and further supporting documentation cannot be accepted.
  
  
• Decision letters outlining the determination of each Claim have been or will be sent to the mailing address or email address the Claims Administrator has on file for the Claimant. The decision was made in accordance with the Settlement Agreement and represents the final determination with respect to each Claim. There is no opportunity for reconsideration or appeal of the decision.
  
  
• All decision letters indicating that a Claim was not approved have been sent out by the Claims Administrator. Decision letters indicating that a Claim was approved will be sent out with the cheque.
  
  
• On July 15, 2026, the Claims Administrator delivered the Successful Claims Report to Class Counsel and counsel for the Defendant.
  
  
• The Defendant made payment to the Claims Administrator for successful Claims within 30 days of receipt of the Successful Claims Report as required under the terms of the Settlement Agreement.
  
  
• Under the terms of the Settlement Agreement, the Claims Administrator has until mid-September 2026 to issue payments to successful Claimants.
  
  
• Payments will be sent by cheque to the last mailing address on file with the Claims Administrator unless the Claimant provides direct deposit information to the Claims Administrator.
