 Important Dates

 

 

Request Your Inmate File
You do Not need your Inmate File from the EMDC in order to make a Claim for any compensation level. Nevertheless, you can request a copy of the records from your placement(s) in the EMDC between October 10, 2011 and November 10, 2021 (specifically, a copy of the records from your institutional file and your health care file).

If you want to use a copy of your Inmate File to prepare your Claim, you must make a written request to the Claims Administrator by January 16, 2024.

Submit a Claim
The only way to receive any compensation from the Settlement is to submit a Claim.

The deadline to submit a Claim is October 16, 2024.

Object

 

The deadline to object to the proposed Settlement is July 20, 2023.

 

Opt-Out – for Sabourin Class only

 

If you were incarcerated at the EMDC between May 18, 2017 and November 10, 2021, you are a Class Member in the Sabourin Action. Your deadline to opt out of the Sabourin Class Action is July 20, 2023.

 

Do NOT opt out if you would like to remain in the Sabourin Class and participate in the proposed Settlement.

 

Do Nothing

 

If the Court approves the proposed Settlement, you can participate by submitting a Claim for compensation at a later date. If you want to participate, and don’t want to object (available to all Class Members) or opt out (available to the Sabourin Class Members only), you are not required to do anything until after the Settlement is approved.

 

Settlement Approval Hearing

 

The Court will hold a hearing on September 13, 2023 at 11:30 am EST at the London Court House to decide whether or not it will approve the proposed Settlement.

 

You can attend the hearing  in person or virtually over ZOOM, although you are not required to do so. You can join via ZOOM by clicking here.

 

You can email the EMDC Class Actions Claims Administrator at info@emdcclassaction.ca to receive updates about the proposed Settlement, including to receive the ZOOM link once it is available.

 

Claims Deadline

Claims for compensation cannot  be submitted until after the proposed Settlement is approved. The deadline to file a Claim will be posted here if the proposed Settlement is approved by the Court.
